Nationwide Law Banning Pipe and Cigar Smoking with Kids in Car?

This morning I was browsing the Internet, looking for some Friday the 13th pipe tobacco deals, and found a long string of questions surrounding a blog post on a site called The post claims that there is a nationwide law banning pipe and cigar smoking in vehicles while there are children present. So, is this true? Is there a federal law or prohibition against smoking in a motor vehicle with kids present?

The short answer is, "no." The fact is that, as of the date of this post, there is no federal or nationwide law banning smoking in a car with passengers who are minors.

However, there are some states and municipalities that have passed local legislation prohibiting smoking of cigarettes, cigars, or pipes in vehicles with minors from under 8 years old up to age 17. According to the National Conference of State Legislatures, eight states including Virginia impose a civil fine if you are caught smoking in a car with minor passengers. For example, in Virgina you can be fined up to $100 if you are caught smoking a pipe, cigar, or cigarette in a car, even if you’re parked, with a child under 8 years old.

So, now you know. Man, surprising that you can't believe everything you read on the Internet! Just kidding.
